Tax residence certificate. What it is and why it is useful to obtain it

In some cases an expatriate who has already settled in Spain, who has a NIE assigned, who is working and registered and who has lived in the country for more than 183 days, may have to prove (both to national and foreign authorities) his tax residence in Spain, by means of an official document.

If this is the case, you will need to apply to the AEAT (Spanish Tax Agency) for the issuance of a “Certificate of Tax Residence”.

This certificate will be issued if your tax residence in Spain can be deduced from the information provided by the AEAT (Spanish Tax Agency). A distinction must be made between the countries of residence in which there is an agreement and those in which there is not.

In the certificates of tax residence in Spain for countries with Agreement, the tax authorities of Spain certify that you are resident in the sense of the Agreement between Spain and the country of residence.

In the certificates of tax residence in Spain for non-Convention countries, the tax authorities in Spain certify that you are resident in Spain.

In both cases the certificate will be issued in Spanish and English.

It can happen, for several reasons, that in spite of meeting all the requirements of tax resident in Spain you are not yet registered, in the census of taxpayers of the AEAT, tax resident: if this were the case, it would be necessary to make a request sending to the administration all type of documentation you have to demonstrate your tax residence (Certificate of census that demonstrates to have been resident during more than 183 days, labour documentation, invoices of supplies and/or receipts of purchases that demonstrate your stay in Spain during more than 183 days).

Once the documentation has been sent, the Administration, after a time of resolution (it can vary a lot depending on the Office to which the application was sent) will be able to issue a “Tax Resident Certificate”.
