Advice on opening bank accounts for non-residents without a NIE (only with a passport or national identity card)
Nowadays, with very few exceptions, most Spanish banks do not accept applications to open a bank account from users who do not have a “Certificado de registro de ciudadano de la Unión Europea,” or green card for EU residents. This can often be very frustrating for expats who have just arrived in Spain and do not yet have this document, but who urgently need to open a Spanish bank account. With our help, any individual can open a bank account at a physical Spanish bank, in any Spanish city (by going there in person, of course), even with just their passport or national identity card.
Obtaining a NIF (Numero de Identificación Fiscal, or Spanish VAT number) for foreign companies, remotely
Essentially, opening a branch of a foreign company in Spain consists of applying for and registering a “NIF” (i.e., a tax identification number) as a “non-permanent establishment” (specifically, as a branch) with the Spanish Tax Agency (Agencia Tributaria).
There are two ways to apply for a Spanish NIF for a foreign company:
1. Prepare all the necessary documentation (I would need a power of attorney authorizing me to represent your foreign company before the Spanish tax authorities for the purpose of applying for the NIF, all documentation relating to the company, such as notarized deeds of incorporation, articles of association, certificates from the Commercial Registry, notarized deeds granting powers and signatures to you and/or other partners/employees, etc.). All documentation must be original and apostilled, accompanied by an official sworn and apostilled translation into Spanish) and, with it, an authorized representative of BarcelonaGlobalService will personally go to a Tax Agency office to submit all the documentation and apply for the NIF. This would be obtained on the same day.
2. Prepare all the necessary documentation (I will need a power of attorney authorizing me to represent your foreign company before the Spanish tax authorities for the purpose of applying for the NIF, all documentation relating to the company, such as notarized deeds of incorporation, articles of association, certificates from the Commercial Registry, notarized deeds granting powers and signatures to you and/or other partners/employees, etc.). All documentation must be original and apostilled, accompanied by an official sworn translation and apostilled in Spanish) and, once all the documentation has been scanned, I would send the application electronically to the Spanish tax agency. In this case, it would take a long time, no less than a month.
This service requires, as a fundamental preliminary step, obtaining a NIE for the person who will be designated as the future legal representative of the foreign company in Spain (this NIE can be requested in person by the interested party, or remotely through BarcelonaGlobalService).
Remote NIE (“Certificado de no residente”) acquisition through special notarized power of attorney
We can obtain a NIE remotely for those who, for whatever reason, are unable to travel to Spain in person.
In this case, we will take care of all the necessary procedures and, once the NIE has been obtained, we will send the original by express courier to the applicant, as well as sending a scanned copy of the document by email.
The process takes about a week/9 days, and requires the applicant to send our offices an original special power of attorney, drawn up by a notary in any country, authorizing our representative to appear before the Spanish police authorities.
In addition to the special power of attorney, bearing an Apostille (the Apostille must be affixed in the country where the power of attorney is drawn up), we will also need a certified translation, in original paper form, to be sent to our offices by post or courier.
If the client does not have a sworn translator, we can put them in touch with our sworn translation partner company in Spain, which offers competitive prices and produces sworn translations very quickly.
Advice on opening bank accounts for foreign companies not resident in Spain
For various reasons (e.g., tenders in Spain), a foreign company may need to open a bank account with a physical Spanish bank.
In just a few days (usually no more than a week), BarcelonaGlobalService can open a corporate bank account for a foreign company (the CEO/legal representative must be physically present in Spain), after the company’s legal documentation, duly apostilled and certified translated into Spanish, has been sent to our offices.
Remote activation (without the physical presence of the applicant) of the “Certificado Digital” for both individuals and legal representatives of Spanish companies.
You may have already heard about a very useful and widely used tool (which we recommend to all our customers) that allows you to carry out practically 99% of all procedures with the public administration in Spain, even the most complex ones such as creating electronic powers of attorney, certifying qualifications, social security procedures, tax procedures (submitting declarations, appeals, etc.), digitally signing documents that are legally valid even remotely, signing contracts and notarial deeds, downloading any type of certificate, completing the “empadronamiento” procedure, and much more…
We are talking about the so-called “Certificado Digital,” also called “Certificado Electronico” or “Certificado del ciudadano” (not to be confused with the “Cl@ve” system, which is now obsolete and useless, as well as incompatible with most public administration IT systems).
As many of you will know (having activated the tool we are talking about), activation of the “Certificado Digital” (Info: https://barcelonaglobalservice.com/2023/07/17/the-utility-of-the-spanish-digital-certificate/ ) requires, first and foremost, that you have a NIE: you must also go in person, with your NIE, identity document, and a printout of an activation code, to any office of the Spanish Tax Agency. It is not possible to send third parties, even if they have power of attorney.
You do not need the green card for EU residents, known as the “Certificado de registro de ciudadano de la Unión Europea,” or even the plastic card (“TIE”) issued to non-EU citizens in Spain. All you need is the simple white non-resident form (even if you no longer have a physical copy but only a scan) of the “Asignación de NIE,” which can be issued to anyone, even if they are not an EU citizen or resident, including through a Spanish consulate, and your national identity document (it does not matter if it is European or non-European, or if it is an identity card or passport) and some of your signatures on the forms that we will send you by email. At that point, within 24 to 48 hours, you will have your “Certificado Digital” ready as if by magic (we will send it to you by email), whether you are a natural person or a company representative. Did you think you had to travel to Spain to get a certificado digital? Nothing could be further from the truth. You can activate it from the comfort of your own home using your PC or cell phone, or even while travelling.
The Digital Certificate can be requested and issued for both individuals and companies (for example, it is used by a company administrator to carry out procedures/signatures on behalf of the company). In the latter case, we would also need a copy of the Spanish company’s articles of association, or any notarial deed proving that the person requesting the Digital Certificate is doing so as the legal representative of the company).
