
People who live in Spain, as well as those from many other countries, might need a “certificate of good conduct” or proof that they don’t have a criminal record.
These certificates are often required for various reasons when dealing with authorities or institutions in other countries. Some common reasons include adoption, school enrollment, applying for a residence permit, getting a visa, or seeking employment.
If you’re an expatriate in Spain, you might find that a new employer asks for a criminal record certificate as part of the hiring process.
In some cases, a “certificado de antecedentes penales” might also be needed if you’re self-employed or own a company in Spain, especially when signing commercial contracts with the Spanish government or local public authorities.
A criminal record is a formal record kept by the judicial system that lists different legal actions, criminal, civil, or administrative, that have been taken against a person.
This certificate may also be requested from non-EU citizens living in Spain to obtain a residence permit. The certificate can be requested in person, by mail, or electronically through an application to the Spanish Ministry of Justice. It is important to have a NIE and to prove the absence of a criminal record, as this may be required unexpectedly, such as for work-related reasons, when you might not have time to request the certificate from the Ministry of Justice. When applying online, you will need to pay a fee and provide your contact details. Normally, the certificate will be issued within 24 hours of submitting the request, though in some cases it may take longer, usually no more than three working days. The official deadline is 10 working days from the receipt of the application. However, if the request is made through an agent, the processing time may be around 15 days.
According to rules set by the Spanish Ministry of Justice, you can ask for a criminal record certificate called «Certificado de antecedentes penales»:
• If you’re in Spain and apply in person, you need to show your Spanish ID card or passport (or NIE if you’re not Spanish) and fill out the official form (form 790).
You also need to pay the required fee.
• If you apply by mail, you must send your application to the Spanish Ministry of Justice.
• If you apply online, you can do so through the Spanish Ministry of Justice’s website.
If you’re a citizen from an EU country (ECRIS nationality), the Spanish Ministry of Justice will check your criminal record in Spain and in your home EU country.
This process might take longer, up to 30 calendar days.
IMPORTANT: The basic «Antecedentes penales» certificate does not allow someone to work with children in Spain.
For that, a special certificate called «Certificado de Delitos de Naturaleza Sexual» is needed, as it’s the only one approved for this purpose.
In some situations, you might need to activate a «Certificado Digital» before you can get a «Certificado de antecedentes penales.» Also, you’ll need to have a Spanish bank account or a debit/credit card linked to your NIE to pay the required fee. Don’t worry, this process is done remotely and can take up to 48 hours. Furthermore, even if you do not have a Spanish account/card in your name, or a digital certificate, we will take care of everything.
